I think the issue is more the erosion of traditional British standards of fairness and the judge should be censored for HIS beliefs!

At the time you posted this Herb , I asked you what your opinion was about the  report...

There was no reply......(?)

Judges do not  get the job by accident .  Their decisions are made within the strict framework of the law , and they can be called to account if mistakes are made.

How could anyone say that these two cases were badly ejudicated , whithout being aware of ALL the facts delivered in court........?

Judges do not  get the job by accident, I agree but do you know how they get the Job ?

I only know one Judge, in fact he is the only one who I have ever met !! They are not the sort of people who live everyday normal lives like the rest of us, so do they understand the majority opinion.

I love the words " The Facts " that is what the Law is based on a Judgement of the Facts. Just sometimes the    " Facts "  are saying something totally different to the people reading them.

Judges are appointed by a system involving the "Judicial Appointments Commission ".........The old "tap on the shoulder " way of doing things has not been used for some time now......Here's a link.

http://www.judicialappointments.gov.uk/index.htm

It would seem to me that efforts are being made to appoint "ordinary people" with "everyday experience", although we are talking about Lawyers here !

(you're correct Frank , I should have said "evidence" )

Bradders I did not comment on your measured response..because I chose not to..I do not choose to get into exchanges that I consider a waste of MY time/

Frank, my feeling on the appointment of judges is that anything done by lawyers is questionable.

Herb whilst I agree with you regarding lawyers, did you really intend to sound so rude in the post prior to that?

Belle, not  rude. just  brief  in kind for the fisherman. Suggest you look back at the post looking for my opinion..that I did not reply to..and the above prompt reminding me that I did not reply... I take Brads jabs as I see them and now generally try to ignore them.

Funny isn't it i didn't read that as a jab at all just a question as to why  you had not replied, everyone hears overtones on here, but they may not be there.
For my own part I get fed up with people arguing against some thing I haven't said. Bradders I don't remember saying the case was badly ejudicated, but that, like the B and B debacle it set yet another precedent that puts Christians in a minority that is not being allowed to practice freely in this so called Democracy of ours...as I said before some are more equal than anothers, and I can think of lots of minortiy groups that would be causing a stink if they were treated this way.

Belle ....It was a genuine question as to why Herb had not responded , and not a jab in any way.

His original post gave no indication as to whether he thought the report in question was a good thing or bad .....I would still  like to know , but it seems that he considers it to be a waste of his time ...I'm not inclined to let this matter drop ......

"things I haven't said".....You certainly did not say that the case was badly ejudicated .

....What I'm trying to get across  is that we , as a group of people at a distance  , are not in any position to criticise judges for their performance , purely on what we are fed by the press , whether one regards them as biased or not .

Herb's post was a classic example of how a few well chosen words could  put a slant on a story. For all we know it could be a complete fabrication. ......but why repeat it here ?  ....and then not be prepared to offer an opinion ....(and checking back there was non)

As I mentioned earlier , I really don't think the B&B issue should ever have come to court. The plaitiffs , whilest being sure of their "rights", brought an unneccesarily aggressive case. (but that's just my view , based on what I've read in the papers.....so who knows ?.... But at least  I am prepared to comment ..eh !)

Re. judges. Perhaps we have to accept that no system is perfect and the judgements that get reported are the tiny minority of controversial ones. Journos short of a real story.

The only judge I was ever inroduced to was Lord Chief Justice Goddard. Can't say I 'met' him, all he did was shake my hand. It was at the season opening luncheon at LCC at Old Trafford and I remember his speech, I would be about 13 I think and he made a real impression on me.

I didn't realise till I read this biog that he was the first LCJ to have a law degree!

I know but what are we to base our judgements on  ??? The media is the only thing we have.
