DEPOSIT AGREEMENT[/center

THE BARNOLDSWICK ARCHIVE

COPYRIGHT The copyright of the copy tapes and original transcripts of the Lancashire Textile Project interviews incorporated in `The Barnoldswick Archive’ are assumed to be Crown Copyright (see attached copy of Steering Committee minutes of 02/11/1978, p.4, section 9.). The copy tapes are owned by Mr Graham as he paid for them, the original transcripts were produced during the process of transcription for him as tools for the job and can be assumed to be his property. All other material deposited is owned by Stanley Challenger Graham and is his copyright unless marked otherwise.

Stanley Challenger Graham retains ownership of the material which is his copyright during his lifetime but agrees that North West Sound Archive shall be able to use the material for publicity, research and teaching purposes. Any publication for profit involving material from `The Barnoldswick Archive’ shall be the subject of a separate agreement between Stanley Challenger Graham and North West Sound Archive.

On the death of Stanley Challenger Graham all of the materials within his gift will be transferred to the North West Sound Archive or their appointed successors by his Literary Executor, Dr S Constantine. In the event of the incapacity of the Literary Executor, the Archivist of the North West Sound Archive or his appointed successor is authorised by Stanley Challenger Graham to effect this transfer. The intent of this clause is to give the NWSA or their successors full ownership and control of the Barnoldswick Archive in perpetuity after Mr Graham’s death.

There is one exception to the above arrangements. The archive of photographic negatives which is the source of all the digitised images included in the materials deposited will remain the property of Stanley Challenger Graham, his heirs and successors. Any use of the images for profit after Mr Graham’s death will be the subject of a separate agreement with his heirs and successors.
