This is a transcript of an Indenture, dated 1785, which is in my possession...

This Indenture of five parts  made the twenty fourth day of June in the twenty fifth year of the Reign of King George the Third, and in the Year of our Lord one thousand seven hundred and eighty five bbetween Joseph BRAMLEY of Halifax in the County of York Merchant, George POLLARD of the same Place Merchant and George JACKSON of Richmond in the said County Esquire, surviving Trustees and Executors named and appointed in and by the Last Will and Testament of Thomas SAYER late of Halifax aforesaid Attorney at Law deceased for Sale of the Tenements and Hereditaments herein after mentioned to be hereby released and covenanted to be surrendered with the Appurtenances of the first part, William WADSWORTH of Hebden Bridge in Wadsworth in the Parish of Halifax aforesaid Inn Keeper of the second part, John APPLEYARD of Hebden Bridge in Wadsworth aforesaid Inn Keeper of the third part, Richard PATCHETT of Hebden Bridge in Wadsworth aforesaid Inn Keeper of the fourth part and Luke CROSSLEY of Great House in Stansfield in the Parish of Halifax aforesaid Gentleman Thomas FOSTER of Park in Erringden in the same Parish of Halifax Stuff Maker and Benjamin PATCHETT of Warley in the same Parish Gentleman of the fifth Part Whereas the said Thomas SAYER being in his life time and at his Death seized to the Use of him and his Heirs of the freehold and customary copyhold Tenements and Hereditaments herein after mentioned to be hereby conveyed or released and covenanted to be surrendered with the Appurtenances  Subject to an Estate for Life to his Mother in Law Mrs Mary COCKCROFT since deceased, and of divers other Tenements and Hereditaments, did by his last Will and Testament in Writing duly executed and attested as the Law required for passing real Estates bearing Date on or about the Nineteenth Day of April  one thousand seven hundred and eighty one, give and devise unto his good friends John ROYDS then of Halifax Esquire (since deceased) and the said  Joseph BRAMLEY George POLLARD and George JACKSON All and every his Messuages Cottages Lands Tenements  Woods and Hereditaments whatsoever and wherever either entire or in Moieties and as well freehold as copyhold Upon trust that they his said Trustees or such of them as should undertake the Execution of the trust or the Survivors or Survivor of them or his Heirs should as they shall think fit and convenient sell and dispose of the whole or any part or parts of his said real Estates either together or in parcels to such person or persons as should be willing to purchase the same, for the best price or prices that could be reasonably be had or gotten and should apply the Money arising therefrom in Discharge of his the said Testators Debts and for other purposes in his said Will mentioned, and did thereby expressly direct that the Receipt and Receipts of his said Trustees or such of them as should undertake the Execution of the Trusts thereby in them reposed, for the purchase Money of the Messuages Lands Tenements Woods and Hereditaments which should be sold by virtue of his Will or any part or parts thereof, should be sufficient and effective to all Intents and Purposes, and that no purchaser or purchasers should be obliged to see the Application of any such purchase Money or any part thereof or answerable for any nonapplication or misapplication thereof and gave sundry specific and pecuniary Legacies to several persons therein named, and as to all the Rest Residue and Remainder of his real and personal Estate whatsoever and wherever (not by him otherwise disposed of) he gave devised and bequeathed the same and every part thereof unto his said Trustees their Heirs Executors Administrators and Assigns upon the Trusts therein aforesaid and appointed the said John ROYDS Joseph BRAMLEY George POLLARD and George JACKSON Joint Executors of his said Will as in and by the same Will relation being thereunto had will more fully appear And whereas  the said Thomas SAYER departed this life soon after the Date and Execution of his said Will without  revoking or altering thereof , and the said Joseph BRAMLEY and George POLLARD two of the said surviving Trustees and Executors have since proved the same Will in the Ecclesiastical Court of the Arch Bishop of York and they and the said George JACKSON have undertaken the Execution of the Trusts reposed in them by the said Will and in pursuance and towards performance of the same Trusts have contracted and agreed with the said William WADSWORTH John APPLEYARD and Richard PATCHETT for the absolute Sale and Conveyance to them their Heirs and Assigns, of the Messuages Cottages Buildings Lands Tenements  and Hereditaments herein after mentioned to be hereby conveyed or released and covenanted to be surrendered with the Appurtenances and the fee simple and Inheritance thereof at and for the Price or Sum of Three Thousand five hundred pounds that being the best price that could be got for the same, the same sum to be paid by the said Purchasers in equal shares  And whereas  the said William WADSWORTH John APPLEYARD and Richard PATCHETT being desirous of making partition of the said purchased premises into three equal parts that each of them his Heirs and Assigns respectively may at all times hereafter hold and enjoy the same in severalty have mutually concluded and agreed to make partition and division thereof amongst them in the Shares and  Manner and subject to the Conditions and Agreements hereinafter for that  purpose limitted or expressed , and that for equality of such partition the said John APPLEYARD shall pay to the said Richard PATCHETT the Sum of Eleven Pounds six Shillings and six pence, and to the said William WADSWORTH the Sum of two pounds fourteen shillings and ten pence halfpenny, and that the same premises shall be allotted conveyed and limitted accordingly as herein after is mentioned  Now this Indenture witnesseth  that in pursuance of the said purchase Agreement and for carrying the same into execution, and for and in Consideration of the Sum of one thousand one hundred and sixty six pounds thirteen shillings and four pence of lawful Money of Great Britain to the said Joseph BRAMLEY George POLLARD and George JACKSON or to some or one of them with the Consent of the other or others of them in hand paid by the said William WADSWORTH on or before the Execution hereof and of the like sum of one thousand one hundred and sixty six pounds thirteen shillings and four pence of like Money also to the said Joseph BRAMLEY George POLLARD and George JACKSON or to some or one of them with the Consent of the other or others of them in hand paid by the said John APPLEYARD also on or before the Execution hereof and of the like sum of one thousand one hundred and sixty six pounds, thirteen shillings and four pence of like money also to the said Joseph BRAMLEY George POLLARD and George JACKSON or to some or one of them with the consent of the other or others of them in hand paid by the said Richard PATCHETT also on or before the execution hereof  which said several Sums amount together to the sum of Three Thousand five hundred pounds and are in full for the absolute Purchase and Price of the Tenements and Hereditaments herein after described and mentioned to be hereby released and covenanted to be surrendered with the Appurtenances, the Receipt of which said several Sums they the said Joseph BRAMLEY George POLLARD and George JACKSON do hereby respectively accordingly own and acknowledge and thereof and therefrom and of and from every of them  and every Part thereof do and every of them doth acquit release and for ever discharge the said William WADSWORTH John APPLEYARD and Richard PATCHETT and every of them and their several Heirs Executors Administrators and Assigns and the purchased Premises by these Presents and also in pursuance of and for carrying into execution the said  Agreement made by the said William WADSWORTH John APPLEYARD and Richard PATCHETT for dividing the said purchased Premises as aforesaid and as herein after is mentioned and for establishing the same according to the true intent  and meaning of the same Agreement and for and in Consideration of the Sum of Eleven Pounds six shillings and six pence of lawful British Money to the said Richard PATCHETT and of the Sum of two Pounds fourteen shillings and ten pence half penny of like Money to the said William WADSWORTH in hand severally paid by the said John APPLEYARD on or before the Execution hereof as and for equality of Partition of the said Premises as aforesaid the Receipt of which Sums the said Richard PATCHETT and William WADSWORTH do hereby respectively accordingly own and acknowledge, and likewise for and in Consideration of the Sum of five shillings a piece of like Money to the said Joseph BRAMLEY George JACKSON William WADSWORTH John APPLEYARD and Richard PATCHETT in hand paid by the said Luke CROSSLEY, Thomas FOSTER and Benjamin PATCHETT on or before the Execution hereof, the Receipt of which Sums is hereby acknowledged They the said Joseph BRAMLEY George POLLARD and George JACKSON in Pursuance of the said Trust in them reposed Have and every of them Hath  (at the Request and by the Direction of the said William WADSWORTH John APPLEYARD and Richard PATCHETT testified by their severally executing hereof) bargained sold aliened conveyed and released and by these Presents Do and every of them Doth bargain sell alien convey and release, and the said William WADSWORTH John APPLEYARD and Richard PATCHETT Have and every of them Hath granted bargained sold aliened conveyed released ratified and  confirmed and by these Presents Do and every of them Doth grant bargain sell alien convey release ratify and confirm unto the said Luke CROSSLEY Thomas FOSTER and Benjamin PATCHETT their Heirs and Assigns all that Messuage Dwellinghouse or Tenement with the Appurtenances called Bannisters Farm situate at Hebden Bridge in Wadsworth aforesaid now or late in the Tenure or Occupation of the said Richard PATCHETT and William WADSWORTH and of Samuel EARNSHAW and Abraham HALLIWELL or their respective Undertenants, And all houses  Cottages Outhouses Stables Barns Buildings Folds Gardens Orchards and  Appurtenances whatsoever thereunto belonging or in any wise appertaining And Also all those several Closes of Arable Meadow or Pasture Ground lying in Wadsworth aforesaid commonly called or known by the several Names of the Croft, the Cowhouse Ing or Holme, the Lower Stubbing, the Higher Stubbing, the Dodnose Field, the Higher Brink the Lower Brink, the Ing and the Low Holme or Thistle Holme, or by what other Names or Name soever the same Closes any of them now are or be or have or hath been called known or distinguished containing together by Estimation Eighteen acres and two Roods be the same more or less now or late in the Tenure or Occupation of the said Richard PATCHETT and William WADSWORTH or one of them or their or one of their Undertenants And Also all those two Cottages or Dwellinghouses  and one Blacksmiths Smithy with their Appurtenances situate at Hebdenbridge in Wadsworth aforesaid now or late in the Occupation of Henry DUGDALE George GREEN and John WILKINSON or their respective Undertenants  And Also all that other Dwellinghouse or Cottage situate at Hebdenbridge in Wadsworth aforesaid now used as a Tollhouse for the Collector of the Tolls at the Turnpike Barr at Hebdenbridge aforesaid or the Ground and Soil whereon the same stands And Also all those several other Dwellinghouses or Cottages, and all the Outhouses Buildings Folds Gardens Orchards and  Appurtenances whatsoever thereunto belonging situate at Hebden Bridge in Wadsworth aforesaid, and at or near a Place there called the Goit side now or late in the several Tenures or Occupations of Joseph RILEY Grace BALDWIN and James RHODES or their respective Undertenants And Also all that other Messuage Dwellinghouse or Tenement called or commonly known by the Name of Bridge End or the White Swan now used as an Inn or Public House and one Slaughter House situate at Hebden Bridge in Wadsworth aforesaid and in Heptonstall in the same Parish of Halifax or in one of those Townships, now or late in the Tenure or Occupation of the said Richard PATCHETT or his Undertenants And all Houses Cottages Outhouses Stables Barns Buildings Folds Gardens Orchards and Appurtenances whatsoever thereunto belonging or in any wise appertaining And Also that Close or Parcel of Ground commonly called or known by the Name of the Gunhill or by what other Name soever the said Close now is or hath been called known or distinguished lying in Wadsworth aforesaid now or lately occupied along with a Farm called Rawroyd in Wadsworth aforesaid by Richard SUTCLIFFE or his Undertenants And also all that Dwellinghouse or Cottage with the Orchard and Appurtenances  situate at Hollings End at Hebden Bridge in Wadsworth aforesaid now or late in the Occupation of Betty COCKCROFT or her Undertenants And Also all that other Messuage Dwellinghouse or Tenement with the Appurtenances called Rawroyd siuate in Wadsworth aforesaid, now or late in the Tenure or Occupation of the said Richard SUTCLIFFE or his Undertenants, and all Houses Cottages Outhouses Stables Barns Buildings Folds Gardens Orchards and Appurtenances whatsoever thereunto belonging or in any wise appertaining And Also all those several Closes of arable Meadow or Pasture Ground to the same Messuage or Tenement belonging lying in Wadsworth aforesaid called or commonly known by the several Names of the Upper Croft, the Lower Croft, the Lower Field, the Ing, the Thistle Field, and the Little Ing containing together by Estimation seven Acres two Roods and ten Perches be the same more or less  And Also all those two other Closes of Ground called the Low Long Field, and the Careful Croft lying in Wadsworth aforesaid heretofore Parcel of a certain Farm called Rowland Lane and now divided into three Closes, containing together by Estimation one Acre one Rood and thirty three Perches be the same more or less or by what other Names or Name soever same Closes or any of them now are or to be or have or hath been called known or distinguished now or late in the Tenure or Occupation of the said Richard SUTCLIFFE or his Undertenants And Also all that Dwellinghouse or Cottage adjoining to the Barn belonging to the said last mentioned Messuage called Rawroyd now or late in the Occupation of James MOSES as Undertenant to the said Richard SUTCLIFFE And Also full and free Liberty License and Authority from time to time and at all times for ever hereafter for the Tenants and Occupiers of the said Messuage Dwellinghouse and Cottage not only to take up water for their domestick and other uses but also to Water their Cattle at the Springs and Wells belonging to the said Farm called Rowland Lane situate in the Township of Wadsworth aforesaid And also all that other Messuage Dwellinghouse or Tenement with the Appurtenances called Kings Farm or the White Lion used as an Inn situate at Hebden Bridge in Wadsworth aforesaid now or late in the Tenure or Occupation of the said William WADSWORTH or his Undertenants And four Cottages or Dwellinghouses with the Hereditament and Appurtenances thereto respectively belonging in the several Occupations of John SALTONSTALL, Mark SUTCLIFFE, John MARCHANT, James PATCHETT and Mary HALLIWELL Widow or their respective Undertenants And all the Houses other the Cottages Outhouses Brewhouses Stables Barns Buildings Folds Gardens Orchards and Appurtenances whatsoever to the same Messuage and Premises or any of them or any part or parts thereof belonging or in any wise appertaining And also all those several Closes of Arable Meadow and Pasture Ground to the same Messuage or Tenement belonging called or commonly known by the several Names of the Ackars being five Fields tho Waste or Wood the Black Pit Holme and the Townend Wife Brink lying in Heptonstall and Wadsworth aforesaid and in Sowerby in the said Parish of Halifax or in some or one of those Townships And Also the several Closes called the Millcroft (now a Garden belonging to the said Messuage called Kings Farm)  the Hard Brink the Gem Lands and the Great Holme (now divided into two) and lying in Wadsworth aforesaid , or by what other Names or Name soever the same Closes or any of them now or be of have or hath been called known or distinguished now or late in the Tenure or Occupation of the said William WADSWORTH or his Undertenants And Also all that Piece or Parcel of Wood and Woody Ground called the New Wood situate and being in Wadsworth aforesaid containing one Rood and thirty six Perches be the same more or less. Which Wood is now broken up and is laid to the said two Closes called the Lower Stubbing and Higher Stubbing belonging to the said Farm called Bannisters Farm And Also all that Piece or Parcel of Wood and Woody Ground called the Hollings situate and being in Wadsworth aforesaid containing fourteen Perches be the same more or less. And Also all that Piece or Parcel of Wood and Woody Ground called the Hollings situate and being in Wadsworth afores the Common Bank situate and being in Wadsworth aforesaid containing five Acres two Roods and twenty four Perches be the same more or less Together with all Houses other the Cottages Outhouses Edifices Barns Buildings Stables Orchards Gardens Folds Fronts Yards Backsides Trees Woods Underwoods and the Ground and Soil thereof Ways Paths Passages Wells Springs Waters Water Courses Commons Common of Pasture and Turbary Mines  Minerals Quarries Rights Liberties Privileges Advantages Hereditaments and Appurtenances whatsoever to the said several Messuages Cottages Closes  Lands Grounds Tenements Hereditaments and Premises or any of them or any part or parts thereof belonging or in any wise appertaining or therewith occupied possessed or enjoyed as part parcel or member thereof (all which said Premises are now in the actual possession of the said Luke CROSSLEY Thomas FOSTER and Benjamin PATCHETT by virtue of a Bargain and Sale to them thereof made by the said Joseph BRAMLEY George POLLARD and George JACKSON for one whole year by Indenture bearing Date the Day next before the Day of the Date of these Presents in Consideration of five shillings a piece therein mentioned and executed before the Execution hereof, and by Force of the Statute made for transferring Uses into possession) And the Reversion and Reversions Remainder and Remainders Yearly and other Rents Issues and Profits of all the said Premises with their Appurtenances And all the Estate and Estates Right Title Interest Use Trust possession Property Claim and Demand whatsoever of them the said Joseph BRAMLEY George POLLARD George JACKSON William WADSWORTH John APPLEYARD and Richard PATCHETT and of every of them of into or out of the same and every or any part or parts thereof To have and to hold the said several Messuages Dwellinghouses or Tenements Cottages Buildings Closes Lands Grounds Tenements Liberties Hereditaments and all and singular other the Premises hereby or mentioned or intended to be hereby released with their and every of their Appurtenances unto the said Luke CROSSLEY Thomas FOSTER and Benjamin PATCHETT their Heirs and Assigns  To and for the several Uses herein after expressed limitted and declared concerning the same premises respectively (that is to say) As for and concerning all that the said Messuage Dwellinghouse or Tenement called Bannisters Farm situate at Hebden Bridge in Wadsworth aforesaid now in the Occupation of the said Richard PATCHETT and William WADSWORTH  and of Samuel EARNSHAW and Abraham HALLIWELL or their respective Undertenants, And also the Barn Smithy, Old House Oven Houses Necessary House Swine Coat Yards Folds Gardens Backsides Middingsteads and Appurtenances thereto belonging and also the said several Closes of Ground called the Croft (except  thirteen Perches and twenty seven Yards thereof herein after limitted to the Use of the said John APPLEYARD his Heirs and Assigns) the Cowhouse Ing or Holme, the Lower Stubbing, the Higher Stubbing, the Higher Brink, the Wast or Piece of Woody Ground called the Hollings below the road in Hollings End, and the Common Bank Wood (which Wood lately belonged to the said Farm called Kings Farm) now or late also in the Tenures or Occupations of the said Richard PATCHETT and William WADSWORTH or their respective Undertenants with the Rights Members Hereditaments and Appurtenances to the same Premises respectively belonging And Also all those the said four Closes of Ground in Wadsworth aforesaid now or lately belonging to the said Farm called Rawroyd and in the possession of the said Richard SUTCLIFFE called the Upper Croft, the further Lawhouse Field, the further Seedhills and the Careful Croft (which Closes called the further Lawhouse Field, the further Seedhills and the Careful Croft were formerly part of the said Farm called Rowland Lane Farm and at that Time the said Further Lawhouse Field and further Seedhills were in one Field and called Low Long Field with the  Hereditaments  and Appurtenances thereto respectively belonging) And Also all those the said several Cottages or Dwellinghouses at Hebden Bridge aforesaid with the Outhousing Gardens Orchards Hereditaments and Appurtenances  thereto respectively belonging occupied by the said Henry DUGDALE George  Green John Wilkinson Joseph RILEY Grace BALDWIN James PATCHETT Mary HALLIWELL Widow and Betty COCKCROFT Together with one full third part or  share of all the Closets Seats Pews Forms and Sittings, and Parts and Shares of Closets Seats Pews Forms and Sittings in the Church or parochial Chapel of  Heptonstall aforesaid belonging to the whole of the said several Messuages Cottages and Hereditaments hereby released as aforesaid To and for the sole proper Use and Behoof of the said William WADSWORTH and of his Heirs and Assigns in severalty absolutely for ever, and which together with the said Sum of two Pounds fourteen Shillings and ten Pence half penny so paid to him for Equality of Partition as aforesaid are and are hereby declared and agreed to be as and for and in full of his the said William WADSWORTHs third part share estate and interest of and in the whole of the said several Messuages Cottages Lands Tenements Hereditaments and Premises as well freehold as customary or copyhold so agreed to be purchased by the said William WADSWORTH John APPLEYARD and  Richard PATCHETT as aforesaid and to be by them divided in manner herein mentioned (subject nevertheless to and for ever hereafter chargeable charged with the Payment of one full third part of all the Lords Rents or other Rents or Outpayments and of the Moduses in Lieu of Tithes which the whole of the said divided Premises are now subject to and chargeable with, and also subject to the Covenants Conditions and Agreements herein after expressed and declared concerning the same Premises respectively) And as for and concerning all that the said Messuage Dwellinghouse or Tenement called the Bridge End or the White Swan situate at Hebden Bridge in Wadsworth aforesaid now used as an Inn or Public House with the Brewhouse Ovenhouse Stable Swine Coat and Garden and other the Appurtenances thereto belonging in the Occupation of the said Richard PATCHETT or his Undertenants And Also the Barn called the Lower Barn situate at Hebden Bridge in Wadsworth aforesaid now occupied by the said William WADSWORTH with the Yard Middingsteads and Appurtenances now occupied therewith Also one Cottage or Dwellinghouse situate at Hebden Bridge aforesaid with the Garden Hereditaments and Appurtenances thereto belonging now occupied by the said James RHODES  And also all that small Piece of Ground containing thirteen Perches and twenty seven Yards of the Westerly side of the said Close called the Croft occupied by the said Richard PATCHETT as the same small Piece of Ground is now staked out from the other Part of the same Close and the Hereditaments and Appurtenances belonging to the same small Piece of Ground And also all the said several Closes of Ground called the West or Upper End of the Great Holme (formerly part of the said Farm called Kings Farm) and the Long Holme or Thistle Holme (part of the said Farm called Bannisters Farm) lying in Wadsworth aforesaid . thereto belonging now in his possession And also all those three Cottages or Dwellinghouses situate at Hebden Bridge in Wadsworth aforesaid in the several Occupations of John SALTONSTALL Mark SUTCLIFFE and John MARCHANT with the Gardens and other Hereditaments and Appurtenances thereto respectively belonging And also all those the said several Closes of Ground in Wadsworth aforesaid called the Little Holme (formerly taken from the Great Holme) the Gemlands the Hard Brink the Ing and the Dodnose Field, now in the Occupation of the said William WADSWORTH and his Undertenants, And also the said Close called the Lower Brink in Wadsworth aforesaid on the South side of the Turnpike Road now in the Occupation of the said Richard PATCHETT (which last named Close and the said Closes called the Ing and the Dodnose Field now are or late were part of or belonging to the said Farm called Bannisters Farm in Wadsworth aforesaid) And also all those four Cottages Closes of Ground in Wadsworth aforesaid called the Gunhill the Thistle Field the Little Ing and the three cornered Close above Law House now in the Occupation of the said Richard SUTCLIFFE (which last mentioned four Closes were formerly occupied in three Closes and are part of the Lands belonging to the said Rawroyd Farm in Wadsworth aforesaid) with the Hereditaments and Appurtenances to the same several Closes of Ground respectively belonging Together with one full third part or share of all the Closets Seats Pews Forms and Sittings and parts and shares of closets seats pews forms and sittings in the Church or Parochial Chapel of Heptonstall aforesaid belonging to the whole of the said several Messuages Cottages and Hereditaments hereby released as aforesaid To and for the sole proper Use and Behoof of the said Richard PATCHETT and of his Heirs and Assigns in severalty absolutely for ever and which together with the said Sum of eleven Pounds  six Shillings and six Pence so paid to him for equality of Partition as aforesaid are and are hereby declared and agreed to be as and for and in full of his the said Richard PATCHETT’s third part share estate and interest of and in the whole of the said several Messuages Lands Tenements Hereditaments and Premises as well freehold as customary or copyhold so agreed to be purchased by the said William WADSWORTH John APPLEYARD  and Richard PATCHETT as aforesaid and to be by them divided in manner herein mentioned (subject nevertheless to and for ever hereafter chargeable with the Payment of one full third part of all the Lords Rents or other Rents or Outpayments and of the Moduses in Lieu of Tithes which the whole of the said divided Premises are now subject to and chargeable with, And also subject to the Covenants Conditions and Agreements hereinafter expressed and declared concerning the same Premises respectively  And whereas  two pieces or parcels of Ground called the Upper Wash and Lower Wash parcel of the said Tenements and Hereditaments agreed to be purchased and divided as aforesaid are customary or copyhold and holden by Copy of Court Roll of the Lord of the Manor of Wakefield in the said County of York and the same two parcels of Ground being a part of the said Tenements and Hereditaments agreed to be allotted and limitted to the said John APPLEYARD in part of his Share of the said divided premises It hath been and is agreed that the same two Pieces or Parcels of Ground shall be surrendered into the Hands of the Lord of the said Manor To the Use of the said John APPLEYARD his Heirs and Assigns as hereinafter is mentioned  Know therefore this Indenture further Witnesseth  that in Pursuance of the said Agreements and for the Considerations aforesaid the said Joseph BRAMLEY George POLLARD and George JACKSON (at the Request and by the Direction of the said William WADSWORTH John APPLEYARD and Richard PATCHETT testified as aforesaid) do hereby for themselves severally and respectively and for their several Heirs Executors and Administrators covenant promise and agree to and with the said Luke CROSSLEY Thomas FOSTER and Benjamin PATCHETT their Heirs and Assigns and also to and with the said William WADSWORTH John APPLEYARD and Richard PATCHETT their several Heirs and Assigns That they the said Joseph BRAMLEY George POLLARD and George JACKSON or their Heirs shall and will forthwith or at any time hereafter on reasonable Request Will and effectually surrender and pass into the Hands of the Lord of the said Manor of Wakefield according to the custom thereof All those the said two customary or copyhold pieces or parcels of ground called the Upper Wash and the Lower Wash being part and parcel of the above mentioned two Closes called Black Pit Holme and Great Holme or one of them which two Closes belong to or are part of the said Farm called Kings Farm and are now in the Tenure or Occupation of the said William WADSWORTH or his Undertenants Together with all Ways, Waters, Watercourses Commons Common of Pasture and Turbary Liberties Privileges Hereditaments and Appurtenances whatsoever to the same two pieces or parcels of Ground or either of them belonging or therewith now enjoyed as appertaining thereto, which customary or copyhold premises are in the Graveship of Sowerby within the said Manor and of the yearly Rent to the Lord of the same Manor of one halfpenny and the Fine in respect thereof compounded for and certain And the Reversion and Reversions Remainder and Remainders Yearly and other Rents Issues and Profits of all the same Premises And all the Estate and Estates Right Title Interest Trust Property possession Claim and Demand whatsoever of the said Joseph BRAMLEY George POLLARD and George JACKSON and of every of them of into or out of the same and every or any part thereof To and for the sole proper Use and Behoof of the said John APPLEYARD his Heirs and Assigns absolutely for ever To be holden of the Lord of the said Manor by Rents Customs and Services therefore anciently Due and accustomed And for the Considerations aforesaid the said William WADSWORTH for himself his Heirs Executors and Administrators doth hereby covenant promise and agree to and with the said John APPLEYARD and Richard PATCHETT and each of them and their several Heirs and Assigns That he the said William WADSWORTH his Heirs and Assigns shall and will at his and their own Expense well and sufficiently make and from time to time for ever hereafter support maintain and keep in good and sufficient Repair all the Southerly fences where any of the Closes of Ground herein above limitted to the use of him and them adjoin to other Grounds from which they are taken, and also the Northerly fence between the said Closes called Cowhouse Ing or Holme and Lower Brink and also the Fence belonging to the said Common Bank Wood adjoining to the said Closes called the Hard Brink and Dodnose Field herein before limitted to the Use of the said Richard PATCHETT his Heirs and Assigns as aforesaid And for the considerations aforesaid the said John APPLEYARD for himself his Heirs Executors and Administrators doth hereby covenant promise and agree to and with the said William WADSWORTH and Richard PATCHETT and each of them and their several Heirs and Assigns, that he the said John APPLEYARD his Heirs and Assigns shall and will at his and their own Expense well and sufficiently make and from time to time for ever hereafter support maintain and keep in good and sufficient Repair the Fence as far as the same adjoins to the Lands herein before limitted to the Use of the said Richard PATCHETT his Heirs and Assigns on the Northerly side of the said Close called Great Holme and also shall and will at his and their own expense immediately make a good substantial New Wall or Fence two Yards high and of a sufficient Thickness for dividing the said thirteen Perches and twenty seven yards the part parts of the said Croft limitted to the Use of the said John APPLEYARD his Heirs and Assigns, from the other part of the same Croft where and as the same is now staked out and from time to time for ever hereafter maintain uphold and keep the same Wall or Fence in good and sufficient Repair and also shall and will at the like Expense well and sufficiently make and from time to time for ever hereafter support maintain and keep in good and sufficient Repair the Fence from the Southerly end of the said Lower Barn to the Top of the said Close called Long Holme and also the Fences on the Westerly side of the said Closes belonging to the said Rawroyd Farm hereby above limitted to the Use of the said John APPLEYARD his Heirs and Assigns adjoining to the Grounds herein before limitted to the Use of the said Richard PATCHETT his Heirs and Assigns And for the considerations aforesaid the said Richard PATCHETT for himself his Heirs Executors and Administrators doth hereby covenant promise and agree to and with the said William WADSWORTH and John APPLEYARD and each of them, and their several Heirs and Assigns, that he the said Richard PATCHETT his Heirs and Assigns shall and will at his and their own Expense well and sufficiently make and from time to time for ever hereafter support maintain and keep in good and sufficient Repair all the Westerly Fences where any of the Closes herein before limitted to the Use of him and them adjoin to other Grounds that they are taken from, and also the Fence with Stoops and Rails in the Manner the same now is between the said Closes called Little Holme and Great Holme and likewise the Fence between the said Closes called Upper Stubbing and Dodnose Field And for the considerations aforesaid it is hereby covenanted declared and agreed by between and amongst the said William WADSWORTH John APPLEYARD and Richard PATCHETT for themselves severally and respectively and for their several Heirs That notwithstanding any Limitation or any other Thing herein contained to the contrary each and every of them the said William WADSWORTH John APPLEYARD and Richard PATCHETT and their several Heirs and Assigns shall have Liberty to dig for and get Stones and do and carry away the same from time to time and at all times hereafter between the first Day of August and first Day of March yearly in the said Common Bank Wood Dodnose Field and Upper Stubbing, for the erecting or making of any Building or Buildings Wall or Walls Fence or Fences Wear or Wears or other Additions to or Improvements upon the said divided Premises or any part or parts thereof, and for repairing thereof and of the present Buildings Walls Fences Wears and other parts of the Premises, the person or persons  so getting Stones digging for and getting the same in the usual manner without making or doing any wilful Waste or Damage thereby, or by the leading and carrying the same away, and making sufficient Fences round the Pits Delves or Places where the Stones shall be got, to prevent Cattle falling in, or being injured or other Damage thereby, and also paying to the Owner or Occupier of the Land where the Stone shall be got Sixpence per Yard for every square Yard of the surface of the Ground broken, and also making sufficient  Satisfaction for every Tree of Wood which may be taken down or damaged thereby and for the Damage done in the Grounds by leading the Stones away  And it is hereby  further covenanted declared and agreed by between and amongst the said William WADSWORTH John APPLEYARD and Richard PATCHETT for themselves severally and respectively and for their several Heirs in manner following (that is to say) That the surplus or Tail of the Water on the Backside of the said Messuage called Kings Farm occupied by the said William WADSWORTH shall continue its usual Course across the road and on the Westerly side of a Smithy at Hebden Bridge aforesaid to a Messuage called the Old House and there shall be diverted out of its present course and run through the Ovenhouse in the Occupation of Joseph RILEY hereby above limitted to the Use of the said William WADSWORTH his Heirs and Assigns and as near as convenient may be to the Westerly corner of the Barn occupied by the said Richard PATCHETT and herein before limitted to the Use of the said William WADSWORTH his Heirs and Assigns and then down by the Southerly Side of that Barn in a direct line until it unite with the Water in the present Water Course at a Stake put down for that purpose at the North side of the said Croft and from thence the Water shall run in its present Course until it comes to another Stake put down at the Easterly Side of a part of a Close called the Croft herein before limitted to the Use of the said John APPLEYARD his Heirs and Assigns at which place the Water shall be diverted from its present Course into a new Water Course to be made on the Easterly side of a Wall to be erected for dividing the said part of the said Croft herein before limitted to the Use of the said John APPLEYARD his Heirs and Assigns from the other part of the same Croft, and then turn at the South Corner thereof into the present Water Course in the said Close called Black Pit Holme Also that the Water running in its present Course from the said Messuage and Buildings called Bridge End otherwise White Swan now occupied by the said Richard PATCHETT shall be carried forwards through the Lands thereto hereby limitted or allotted and through the said intended New Wall into the said New Watercourse in the same Direction it now runs, and that the Branch of the said Watercourse which conveys the Water into the said Close called Cowhouse Ing or Cowhouse Holme shall be continued forwards as now marked or set out through the West corner of that Ing into and down the Northside and to the North East Corner of the said Close called Long Holme or Thistle Holme and from thence into the Ing herein above limitted to the Use of the said Richard PATCHETT his Heirs and Assigns Also that the said Old Water Course out of which the Water is to be diverted into the New Course as aforesaid shall be filled up at the joint equal Expense of the said William WADSWORTH John APPLEYARD and Richard PATCHETT their several Heirs and Assigns, and the Water never more to run therein, and that the new Watercourses above agreed to be made shall be made and at all times hereafter kept in good and sufficient Repair at the like joint equal Expense so far as every of them the said William WADSWORTH John APPLEYARD and Richard PATCHETT  their several Heirs or Assigns shall be jointly interested in or benefited by the Water running therein And where any of the said several persons to whom any of the said Hereditaments and Premises are hereby allotted or limitted as aforesaid or their several Heirs or Assigns shall be separately interested in or benefited by the same Water according to the Agreements herein contained such person or persons respectively and their several Heirs and Assigns so respectively interested in or benefited by the Water shall make and at all times repair the said Water Courses at their or his own Expense respectively Also that the said Water Course shall be directed and finished and the old Water Course filled up in manner aforesaid on or before the second Day of February next, and from thence forwards for ever hereafter the said William WADSWORTH John APPLEYARD and Richard PATCHETT their several Heirs and Assigns for and in respect and for the Benefit of the said Lands and Grounds hereby above limitted to them respectively shall have the Use and Benefit of the Water therein in the following order and manner (that is to say) the said Richard PATCHETT his Heirs and Assigns shall begin to take the same Water at the Hour of Ten in the morning of the first Tuesday in the same February and have the sole Use and Benefit thereof for one whole Week until the Hour of Ten in the morning of the Tuesday then next following at which Hour in the same Morning the said William WADSWORTH his Heirs and Assigns shall take the whole of the same Water and have the sole Use and Benefit thereof for one whole Week until the Hour of Ten in the Morning of the Tuesday then next following at which Hour in the same Morning the said John APPLEYARD his Heirs and Assigns shall take the whole of the same Water and have the sole Use and Benefit thereof for one whole Week until the hour of Ten in the Morning of the Tuesday then next following, and in like manner the said Richard PATCHETT William WADSWORTH and John APPLEYARD and their several Heirs and Assigns shall have the Use of the said Water week for week in the same Order and Manner alternately for ever Also that the said William WADSWORTH and John APPLEYARD and their several Heirs Tenants and Assigns in their respective Weeks of having the said Water as aforesaid shall have Liberty to scour the Water Course with Coalrake and Besom to the place where it crosses the Turnpike Road, and that the said John APPLEYARD and Richard PATCHETT and their several Heirs Tenants and Assigns in their respective Weeks of having the said Water as aforesaid shall have the Liberty to scour the common Water Course with Coalrake and Besom but no nearer to the said Ovenhouse herein before limitted to the Use of the said William WADSWORTH his Heirs and Assigns than where the Water running through the same shall unite with the Water in the said common Water Course up to the and shall also have Liberty to scour and sweep the said common Water Course up to the Turnpike Road but the said William WADSWORTH John APPLEYARD and Richard PATCHETT or any of them or their several Heirs or Assigns or their or any of their Tenants shall not without Leave for that purpose have Liberty to go into each others Yards to scour the said Watercourse there or otherwise nor shall the said William WADSWORTH his Heirs Tenants or Assigns have Liberty to divert or turn the Water running to the Mill on the South side of the said Bannisters Farm House out of its present Course to the Prejudice of the said John APPLEYARD and Richard PATCHETT or either of them or their several Heirs Tenants or Assigns, nor shall the said William WADSWORTH and Richard PATCHETT or either of them or their several Heirs Tenants or Assigns have Liberty to sweep or scour any of the short Watercourse between the said Messuage called Bridge End or White Swan Inn and the said common Watercourse Also that when any part or parts of the said Water Courses shall be out of Repair the said William WADSWORTH John APPLEYARD and Richard PATCHETT respectively and their several Heirs Tenants and Assigns shall have Liberty respectively to go on to the Tenements and Hereditaments herein above limitted to each other to scour and repair the same when necessary and to carry Materials for that purpose doing no wilful Damage thereby And it is hereby further covenanted declared and agreed by between and amongst the said William WADSWORTH John APPLEYARD and Richard PATCHETT for themselves severally and respectively and for their several Heirs and Assigns That a good substantial Lead or Stone cistern of sufficient Dimensions shall on or before the first Day of December next at the joint equal Expense of the said William WADSWORTH John APPLEYARD and Richard PATCHETT their several Heirs or Assigns be fited and continued within the Distance of seven Yards from the Westerly End of the Brewhouse at the said Messuage called Kings Farm or White Lion Inn, and a Lead Pipe shall be fited in the cistern sufficient to convey therefrom as much Water as will supply four Pipes of half an Inch bore each, which principal Pipe shall be laid from the said Cistern down the Backside belonging to the same Messuage and across the Turnpike Road and through the said Joseph RILEYs Ovenhouse to the West End of the Barn herein before limitted to the Use of the said William WADSWORTH his Heirs and Assigns and forwards in a straight Line to the North Corner of the said intended New Wall for dividing the part of the said Croft herein before limitted to the Use of the said John APPLEYARD his Heirs and Assigns from the Residue of the same Croft, and from thence to a Place called the Bottom of the Fold in Heptonstall aforesaid, and the said Richard PATCHETT his Heirs and Assigns shall have a Right to take one Branch of half an Inch bore out of the said principal pipe in respect and for the sole Use of the said Tenements and Hereditaments hereby above allotted or limitted to the Use of him and them. And shall also have a Right to take another Branch of the same Bore out of the same principal pipe at the corner or North End of the said intended New Wall for dividing the said Croft to and for the Use of his Tenants Tenements Tenants at the bottom of the Fold aforesaid (not being part of the Tenements hereby intended to be divided) and the said John APPLEYARD his Heirs and Assigns shall have a Right to take another Branch of the same Bore out of the said principal pipe in respect and for the sole Use of the said Tenements and Hereditaments hereby above allotted or limitted to the Use of him and them , and shall also have a Right to take another Branch of the same Bore out of the same principal pipe for the use of the Tenements he now occupies at Hebden Bridge aforesaid (not being part of the Premises hereby intended to be divided) and that every one of the said Pipes shall have a cock fited at the end thereof and kept turned so as to prevent any Wast of Water or Water being drawn therefrom to the Prejudice of any of the other parties but when such drawing is necessary for the Use of their respective Houses intended to be served thereby and that the said William WADSWORTH John APPLEYARD and Richard PATCHETT their several Heirs Tenants and Assigns or any of them shall not be at any Expense respecting the said Pipes any further than they receive Benefit therefrom respectively, And that a cock shall be fited and kept turned at the End of the present Lead Pipe adjoining or near to the Road at the North East Corner of the Cellar belonging to the said Messuage called Kings Farm or White Lion Inn to prevent the Loss of Water which Cock shall be fited and the same and the Pipe shall at all times hereafter be kept in good and sufficient Repair at the joint equal Expense of the said William WADSWORTH John APPLEYARD and Richard PATCHETT their several and respective Heirs Tenants or Assigns and the said Joseph BRAMLEY George POLLARD and George JACKSON for themselves severally and respectively and for their several Heirs Executors Administrators Acts Deeds and Defaults only and not jointly or one for the other or others or the Heirs Executors Administrators Acts Deeds or Defaults of one another, do hereby severally covenant declare and agree to and with the said William WADSWORTH John APPLEYARD and Richard PATCHETT severally and respectively and their several and respective Heirs and Assigns, That they the same Joseph BRAMLEY George POLLARD and George JACKSON have not nor hath any of them at any time heretofor made done or committed or knowingly suffered any Act Matter or Thing whatsoever whereby or by means whereof the said Tenements Hereditaments and Premises hereby or herein above mentioned mentioned to be hereby released and covenanted to be surrendered or any part or parts thereof or the Title Property or possession thereof are is or can shall or may be impeached charged incumbred or affected in any wise howsoever And also that they the said Joseph BRAMLEY George POLLARD and George JACKSON and every of them and their several and respective Heirs and Assigns, and all and every other Person and Persons having or lawfully or equitably claiming or who shall or may so have or claim any Estate Right Interest Trust or Title Claim or Demand whatsoever of into or out of the same Tenements Hereditaments and Premises or any part or parts thereof with the Appurtenances under or in trust for them or any of them, or by means of their or any of their Acts Defaults Afsent Consent Procurement or Privity shall and will at and within any reasonable time or times hereafter upon every reasonable Request and at the Expense of the said William WADSWORTH John APPLEYARD and Richard PATCHETT or any of them or their several Heirs or Assigns make do acknowledge levy suffer pass and execute all and every or any such further and other lawful and reasonable Act and Acts Deed and Deeds Devisces Conveyances and Assurances in the Law whatsoever for the further better more perfect and effectual conveying and assuring of the same Tenements Hereditaments and Premises with the Appurtenances To and for the several Uses Intents and Purposes herein above limitted and declared concerning the same respectively as by the said William WADSWORTH John APPLEYARD and Richard PATCHETT their several Heirs or Assigns or any of them or their or any of their counsel in the Law shall be reasonably advised and required so as such further Assurances contain in them no further or other Covenants or Engagements than are herein contained, and so as the Person or Persons who shall be required to make the same be not compelled or compellable for the making or doing thereof to travel from the Place or Places of his her or their Habitation or Abode And the said William WADSWORTH and John APPLEYARD for themselves severally and respectively and not jointly and for their several Heirs Executors Administrators Acts Deeds and Defaults only,  do hereby severally covenant declare and agree to and with the said Richard PATCHETT his Heirs and Assigns, that they the said William WADSWORTH and John APPLEYARD have not nor hath either of them at any time heretofor done committed or knowingly permitted or suffered nor will they or either of them or their several Heirs or Assigns hereafter do commit or suffer any Act Matter or Thing whatsoever whereby or by means whereof the said Tenements Hereditaments  and Premises herein before limitted in Use to the said Richard PATCHETT in Fee as aforesaid or the Title Property or possession thereof,  are is or can shall or may be impeached charged incumbred or affected in any wise howsoever or whereby or by means whereof the said Richard PATCHETT his Heirs or Assigns can shall or may be hindered or interrupted from or in the peaceable Enjoyment thereof,  but on the contrary that they the said William WADSWORTH and John APPLEYARD their several Heirs and Assigns and all claiming under them either or any of them shall and will upon Request make do acknowledge suffer and execute all such further and other lawful and reasonable Acts Deeds and Assurances for the better Confirmation of the aforesaid Partition and assuring the said Tenements Hereditaments and Premises herein before limitted in Use to him his Heirs and Assigns the said Richard PATCHETT in Fee as aforesaid unto and to the Use of him his Heirs and Assigns for ever, according to the purport and the true Intent and Meaning hereof, and of the Parties hereto,  as by the said Richard PATCHETT his Heirs or Assigns, or his or their counsel in the Law shall be in that Behalf reasonably advised prepared or required And the said John APPLEYARD and Richard PATCHETT for themselves severally and respectively and not jointly and for their several Heirs Executors Administrators Acts Deeds and Defaults only, do hereby severally covenant declare and agree to and with the said William WADSWORTH his Heirs and Assigns that they the said John APPLEYARD and Richard PATCHETT have not nor hath either of them at any time heretofor done committed or knowingly permitted or suffered nor will they or either of them or their several Heirs or Assigns hereafter do commit or suffer any Act Matter or Thing whatsoever whereby or by means whereof the said Tenements Hereditaments and Premises herein before limitted to the Use of the said John APPLEYARD in Fee as aforesaid or the Title Property or possession thereof are is or can shall or may be impeached charged incumbred or affected in any wise howsoever, or whereby or by means whereof the said John APPLEYARD his Heirs or Assigns can shall or may be hindered or interrupted from or in the peaceable Enjoyment thereof but on the contrary, that they the said William WADSWORTH and Richard PATCHETT their several Heirs and Assigns and all claiming under them either or any of them shall and will upon Request make do acknowledge levy suffer and execute all such further and other lawful and reasonable Acts Deeds and Assurances for the better Confirmation of the aforesaid Partition and assuring the said Tenements Hereditaments and Premises herein before limitted in Use to him the said John APPLEYARD in Fee as aforesaid unto and to the Use of him his Heirs and Assigns for ever, according to the purport and the true Intent and Meaning hereof and of the Parties hereto,  as by the said John APPLEYARD his Heirs or Assigns, or his or their Counsel in the Law shall be in that behalf reasonably advised prepared or required   In Witness
